El Poder Judicial declaró fundada la apelación presentada por la defensa del gobernador regional del Callao, Ciro Castillo Rojo Salas, y anuló la orden de prisión preventiva que pesaba en su contra en el marco de la investigación por presunta organización criminal y colusión agravada. Con esta decisión, el gobernador continuará siendo investigado en libertad y queda habilitado para retomar sus funciones desde este lunes 2 de febrero.
La resolución fue emitida por la Sala Penal de Apelaciones, que revocó el fallo de primera instancia que había dispuesto 24 meses de prisión preventiva, además de ordenar su ubicación y captura. El colegiado concluyó que no se cumplían de manera suficiente los presupuestos exigidos para imponer la medida más gravosa, en especial en lo referido al peligro procesal.
Con esta decisión, la autoridad chalaca continuará siendo investigada en libertad y quedaría habilitada para reasumir sus funciones al frente del Gobierno Regional del Callao a partir de este lunes 2 de febrero.
Este caso se conoció a finales de 2025, cuando el Ministerio Público, a través de la Fiscalía Provincial Corporativa Especializada en Delitos de Corrupción de Funcionarios del Callao, solicitó medidas contra Castillo Rojo y otros implicados por presunta participación en una organización criminal, vinculada con el direccionamiento de más de 60 contrataciones públicas irregulares durante 2023 que habrían causado un perjuicio económico de más de S/1,4 millones al Estado.
Cabe recordar que, en enero de este año, el Poder Judicial acogió el pedido del Ministerio Público y dictó prisión preventiva contra Castillo Rojo al considerar que existían graves y fundados elementos de convicción sobre su presunta participación en el caso conocido como Los Socios del Callao. La Fiscalía sostiene que, durante su gestión como gobernador regional, se habría integrado a una organización criminal que operaba en el interior del Gobierno Regional del Callao para direccionar contrataciones públicas a favor de determinados empresarios.
Según la tesis fiscal, Castillo Rojo habría tenido un rol clave en la presunta red, facilitando la adjudicación irregular de obras y servicios a cambio de beneficios indebidos. En su momento, el Ministerio Público también argumentó que existía riesgo de fuga y de obstaculización de la investigación, debido a la influencia política del investigado y a su presunta capacidad para interferir en la actuación de testigos.
No obstante, la Sala consideró que dichos riesgos no fueron debidamente acreditados, señalando que el imputado cuenta con arraigo domiciliario, laboral y familiar, además de haberse presentado voluntariamente ante las autoridades. Asimismo, el tribunal precisó que las medidas menos gravosas resultan suficientes para garantizar su sometimiento al proceso, por lo que dejó sin efecto la prisión preventiva.
Con esta decisión, Ciro Castillo Rojo continuará el proceso bajo comparecencia, sujeto a reglas de conducta, mientras avanzan las diligencias fiscales. En el plano político-administrativo, la anulación de la medida cautelar le permite reasumir el cargo de gobernador regional del Callao, del cual se encontraba suspendido tras la orden de captura dictada en su contra.
